Introducing Judge Brett Kavanaugh, Trump’s SCOTUS Nominee

President Trump’s new pick for Supreme Court Justice is Brett Kavanaugh,United States Circuit Judge of the United States Court of Appeals for the District of Columbia Circuit.

Before Kavanaugh was even named, the rent-a-mob ‘protesters’ had already gathered, and ABC news ‘journalist’ Terry Moran blasted Trump’s pick as ‘controversial’ and bloviated about ‘the possible implications for the country.’

Website Campus Reform has a hilarious video out of college students criticizing Trump’s pick as ‘racist’ and ‘right wing’… day’s before the new nominee was even named!

What were seeing here, of course is the modern equivalent of the sheep in George Orwell’s ‘Animal Farm.’ No matter what was going on, the only thing they knew how to do was chant “Two legs bad, Four legs good.’ All the media clowns and Lefties know is that one act, and it doesn’t matter what Trump does. It’s always the same old crap, and like the sheep, many of them are simply incapable of learning anything else. All they can do is hate, and since it’s been so consistent, it’s lost its force. Most Americans know by know that if our president ran into a lion’s cage to save a toddler, the headlines would read – ‘Trump invades home of African American and steals his lunch.’

So let’s take a good luck at Brett Kavanaugh without the Left’s hysterics, shall we?

Judge Brett Kavanaugh is 53 and has a fairly distinguished record. He’s a Yalie, who first worked as a law clerk for Judge Walter King Stapleton of the United States Court of Appeals for the Third Circuit and Judge Alex Kozinski of the United States Court of Appeals for the Ninth Circuit.He then earned a one-year fellowship with the Solicitor General of the United States, Ken Starr. After which Kavanaugh clerked for Supreme Court Justice Anthony Kennedy.

George W. Bush nominated him to the United States Court of Appeals for the District of Columbia Circuit on July 25, 2003, but that nomination was stalled by the Democrats for three whole years because ‘Bush did it.’ You see, the Left hasn’t changed…they never do. He finally was confirmed on May 26, 2006.

So what is his judicial thinking like? Remember, that the DC circuit leans very Left.

Brett Kavanugh has already stated that he considers Roe v. Wade binding under the principle of stare decisis but he t has also ruled in favor of some restrictions for abortion on demand. Horrors! He actually thinks under certain circumstances a human baby developed beyond a certain point has a right to live!

Second Amendment? After Heller v. District of Columbia (2011), Kavanaugh opposed a D.C. city law banning possession of semi-automatic rifles and requiring registration of all firearms. Kavanaugh extended Heller’s ruling that handguns — even semi-automatic ones — are constitutionally protected. He argued that “there is no meaningful or persuasive constitutional distinction between semi-automatic handguns and semiautomatic rifles.”

“Semi-automatic rifles, like semi-automatic handguns, have not traditionally been banned and are in common use by law-abiding citizens for self-defense in the home, hunting, and other lawful uses. Moreover, semiautomatic handguns are used in connection with violent crimes far more than semi-automatic rifles are.”

He also wrote some great dissenting opinions on federal regulations that allowed the EPA to avoid things like cost benefit analyses. After Judge Kavanaugh’s dissent from the decision allowing the agency to disregard cost–benefit analysis, the Supreme Court reversed it 5–4 in Michigan v. EPA. Justice Antonin Scalia quoted Kavanaugh’s dissent that the EPA’s refusal to consider costs ‘was unreasonable.’

Judge Kavanaugh’s Record on Second Amendment/Gun Rights …

Drawbacks? Sure. First, he’s 53. I might have preferred Amy Coney Barrett  who’s only 41 and would have brought a G-d fearing moral presence. Although I also concede she probably needs a little more experience, so it might be wise to save her for Ruth Bader Ginsberg’s seat. I imagine RBG’s exit will be something like this, with Ms. Barrett taking RBG’s  broomstick umm, seat as a victory trophy.

Second, his involvement with the George W. Bush administration raises my hackles, even if he was just a functionary. But he seems to have enough originalist cred as far as I can tell.

And finally there was his involvement in Seven-Sky v. Holder (2011) paved the way for Supreme Court Chief Justice John Roberts to defend Obamacare as a tax in NFIB v. Sebelius (2012).

Nobody’s perfect.

But I think overall we have a worthy successor to Justice Kennedy, someone who prizes our constitution as the treasure it is. And of course, Judge Brett Kavanaugh absolutely drives all the right people insane. 

That’s a major plus in itself.
